1. Service Description

Lumio Leads is a B2B SaaS platform designed for Indian digital marketing agencies. The Service provides lead generation, CRM management, website audit tools, campaign management, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

2. Account Registration

To use the Service, you must:

• Be at least 18 years of age and legally competent to enter into binding agreements
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

Each agency (organization) is entitled to one account. Agency Administrators can invite team members (Staff) to access the account with limited permissions.

3. Subscription Plans & Payments

a) Plans

We offer three subscription tiers:

• Basic: ₹999/month — 1,000 lead credits, core features
• Pro: ₹2,999/month — 5,000 lead credits, advanced features
• Enterprise: ₹7,999/month — 10,000+ lead credits, priority support, custom integrations

b) Billing

• Payments are processed via PhonePe and Razorpay Payment Gateways
• Subscriptions auto-renew at the end of each billing cycle
• GST (18%) is applicable and will be charged separately where required
• Prices are listed in Indian Rupees (₹) and inclusive of applicable taxes unless stated
• We reserve the right to change pricing with 30 days' written notice

c) Credits

Lead credits reset at the beginning of each billing cycle. Unused credits do not carry over. Additional credits may be purchased separately.

4. Refund Policy

We offer a 7-day refund policy from the date of purchase. For full details, please refer to our dedicated Refund Policy.

All refunds are processed through PhonePe or Razorpay and may take 5–7 business days to reflect in your account.

5. User Obligations

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of Indian laws
• Scrape, extract, or collect data that you do not have the legal right to access
• Send unsolicited communications (spam) to leads or contacts obtained through the platform
• Resell, sublicense, or redistribute the Service without written authorization
• Attempt to reverse-engineer, decompile, or otherwise access the source code
• Use the Service to send more than 20 cold outreach messages per day per connected number (WhatsApp/email policy)
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit viruses, malware, or any code of a destructive nature

6. Acceptable Use & WhatsApp Policy

Lumio Leads provides WhatsApp outreach via official WhatsApp URL schemes. Users are solely responsible for compliance with WhatsApp's Terms of Service and applicable Indian telecom regulations (TRAI DND guidelines). We recommend keeping outbound messages to under 20 per day per phone number to avoid being flagged as spam.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, code, and software — are the exclusive property of Lumio Leads and are protected by Indian and international copyright, trademark, and other intellectual property laws. Your business data (leads, campaigns, etc.) remains your property.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• We are not liable for any data loss, business interruption, or leads that do not convert
• We are not responsible for the actions of third-party services (PhonePe, Razorpay, WhatsApp, Google Maps, etc.)

9. Indemnification

You agree to indemnify, defend, and hold harmless Lumio Leads, its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account for violation of these Terms, fraudulent activity, non-payment, or at our discretion with 30 days' notice. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account deletion request, as per our Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
